Welcome to www.mixmastudio.com, the “Site”, owned and operated by Mixma Studio LLC, a Wyoming limited liability company (“Mixma,” “we,” “us,” or “our”). These Terms of Use (“Terms”) constitute a legally binding agreement governing all access to and use of the Site.

By accessing, viewing, or using the Site in any manner whatsoever—including browsing, viewing images, downloading content, or submitting inquiries—you acknowledge and agree to be bound by these Terms without limitation or qualification.

Unauthorized replication(s) of our proprietary processes have resulted in ongoing legal proceedings in New York Supreme Court.

1. OWNERSHIP OF INTELLECTUAL PROPERTY AND TRADE SECRETS

All content made available on the Site—including, without limitation, photographs, images, videos, designs, text, drawings, specifications, material descriptions, surface treatments, workflows, processes, techniques, and the proprietary glazed lava stone manufacturing methods (collectively, the “Content”)—is the exclusive intellectual property and confidential trade secrets of Mixma Studio LLC, Christopher Carlyle Kinlaw, and affiliated MIXMA entities, unless expressly stated otherwise.

The Content is protected by U.S. federal copyright law (Title 17, United States Code), U.S. trade secret law, state unfair competition statutes, and applicable international intellectual property treaties. No ownership rights are transferred by virtue of access to the Site.

Any attempt to copy, imitate, replicate, reverse engineer, derive, analyze, disclose, or commercially exploit the Content or any proprietary manufacturing technique—whether directly or indirectly, in whole or in part—constitutes willful infringement and misappropriation.

2. ABSOLUTE PROHIBITION ON COPYING OR PROCESS REPLICATION

You are expressly prohibited from:

Downloading, capturing, reproducing, or redistributing any photographs or images from the Site;
Using Site imagery for reference, inspiration, benchmarking, or derivative works;
Attempting to replicate or approximate the proprietary glazed lava stone technique or any related process;
Reverse engineering materials, surfaces, finishes, or methods displayed or described on the Site;
Using any Content to develop competing products, materials, or services.

Any such conduct will be treated as intentional and willful.

3. LIMITED LICENSE — NO COMMERCIAL OR DERIVATIVE USE

You are granted a strictly limited, revocable, non-exclusive, non-transferable license to view the Site solely for personal, non-commercial informational purposes.

This license does not permit:

Commercial use of any Content;
Creation of derivative works;
Use of Content in presentations, portfolios, mood boards, AI training datasets, or promotional materials;
Use of Content for manufacturing, fabrication, or design development.

All rights not expressly granted are expressly reserved.

4. ENFORCEMENT, INJUNCTIVE RELIEF, AND DAMAGES

Unauthorized use of the Site or Content will be pursued aggressively and without further notice.

Mixma reserves the right to seek immediate injunctive relief in U.S. federal court, without the necessity of posting bond, to prevent ongoing or threatened infringement or misappropriation.

Available remedies include, without limitation:

Temporary, preliminary, and permanent injunctions
Statutory damages and/or actual damages
Disgorgement of profits
Seizure and destruction of infringing materials
Recovery of attorneys’ fees and costs
All remedies available at law and in equity

5. DMCA TAKEDOWN AND PLATFORM ENFORCEMENT

Mixma actively monitors unauthorized use of its intellectual property. Any infringing content hosted on third-party platforms will be subject to immediate DMCA takedown notices pursuant to 17 U.S.C. § 512.

Repeat or willful infringement will result in escalated legal action beyond takedown procedures.

6. NO LICENSE; NO IMPLIED RIGHTS

Nothing on this Site shall be construed as granting any license, right, or authorization—whether express, implied, or otherwise—to use any Mixma intellectual property without prior written consent.

Silence or inaction does not constitute consent.
